ANCOM: Users of electronic communications services must be informed when exhausting their included resources and reaching 250 lei additional costs

The National Authority for Administration and Regulation in Communications of Romania (ANCOM) reminds users of telephone and internet access services that they have the right to be informed when they have fully consumed the resources included in the subscription and when they have accumulated additional costs of 250 lei (50 euros), excluding VAT.

ANCOM has imposed these obligations on providers in order to increase transparency and to allow users to better control the costs resulting from the use of electronic communications services.

Providers of electronic communications services have the legal obligation to inform users in two critical consumer situations:

  1. Upon exhaustion of the resources included in the subscription – when the volume of service resources (minutes, SMS, mobile data, etc.) included in the tariff plan is fully consumed.
  2. Upon reaching an additional consumption threshold of 250 lei (50 euros), excluding VAT – when, after exceeding the value of the subscription, users accumulate additional costs in the amount of 250 lei (50 euros), excluding VAT, providers are obliged to issue a clear and prompt notification. Depending on the commercial policy of the providers, this additional cost may also include the costs incurred when accessing value-added services.

Important! These obligations also apply with respect to end-users who are micro-enterprises, small enterprises or non-profit organisations if they have not explicitly agreed to waive their application in whole or in part.

If there are any doubts about the services invoiced, users have the right to receive itemized bills, which providers are obliged to submit upon request. They must contain a minimum set of details, which should enable them to identify the services used and the tariffs charged. Details to be provided in the itemized bill are available here.

How to complain, what and where to report
If the information obligations above are  breached, users can complain to ANCOM, following the steps described here.

Attention! The legal provisions in force do not empower ANCOM to carry out checks on the traffic logging at the operator's switch.

If providers do not comply with the contract provisions, consumers can complain to the National Authority for Consumer Protection (ANPC), while end-users who are micro-enterprises, small enterprises or non-profit organizations can turn to authorized mediators or courts. ANCOM can provide advice, but it is not empowered to sanction providers in such situations.
